There are four Indian casinos located in upstate New York which offer traditional Class III casino gambling.
The terms of the compact between the tribes and the state only allow table games. Slot machines are not permitted. However, all of the tribes have video gaming machines which offer slot-style games, plus video keno and video poker. These machines do not pay out in cash. PARI-MUTUEL CASINOS
In October 2001, legislation was passed to allow for the introduction of slot machine-type video lottery machines at eight racetracks. Officially referred to as Video Gaming Machines (VGM's), they are regulated by the New York State Lottery Division.
All VGM's offer standard slot machine-type games, plus keno in denominations from five cents to $10. The machines all accept cash but do not pay out in cash. They print a receipt which must be taken to a cashier.
According to a spokesperson at the Lottery's headquarters, "no public information is available concerning the actual payback percentages on the machines." However, the legislation authorizing the VGM's states, "the specifications for video lottery gaming shall be designed in such a manner as to pay prizes that average no less than ninety percent of sales."
As of July 2004 there were four tracks offering the VGM's: Finger Lakes, Saratoga, Monticello (Might M Gaming) and Buffalo Raceway. That same month a N.Y. state appeals court ruled that part of the law authorizing VGM's was illegal. The court said that all of the profits generated by the machines must go to education and cannot go to the racetracks. New York legislators are attempting to resolve this issue and it has delayed the introduction of VGM's at the other four racetracks. If you are planning a trip to any of those four tracks, it would be best to call ahead to check the status of their VGM's.
All Video Gaming Machine facilities are open from 10am to 2am daily. The minimum gambling age is 18 for playing VGM's, as well as for betting on horse and harness racing.
